"So it could be that this ends up in the Supreme Court and what happens after that, who knows."

Professor McEwen then highlighted some of the difficulties SNPs might face from Westminster if they go this route.

"The bigger challenge is that even if the Supreme Court finds that the legislation is within the jurisdiction of the Scottish Parliament, that in itself does not guarantee that you have a process seen by all parties," she said. is legal.

"You need acceptance from those who support independence and those who oppose it that this is an issue that needs to be addressed by the people of Scotland.
